Privacy Policy
This privacy policy describes the personal data collected or processed when you visit oyoyovolleyball.com (the "Site") and sign up to receive email updates from oYoYo. oYoYo is a premium women's volleyball apparel brand (beach and indoor) that has not yet launched its online store. At this stage the Site is a single pre-launch page that collects your email address so we can notify you about the brand and our upcoming launch — it does not sell products, process payments, or collect fitness, body-measurement, or performance data of any kind.
This policy is issued by OYOYO Volleyball Limited Partnership ("oYoYo," "we," "us," or "our"), a British Columbia limited partnership, acting by its general partner, VOVOMO GP Inc. Our related company, VMO Limited Partnership, provides shared technology and platform services used to operate the Site — see "Sharing of Your Personal Data" below.
This privacy policy may be available in languages other than English. To the extent of any inconsistency or conflict between this English privacy policy and a version available in another language, the most current English version of this privacy policy, located at https://oyoyovolleyball.com/privacy, will prevail. Any disputes arising out of this privacy policy will be resolved in English unless otherwise determined by us (acting in our sole discretion) or as required by applicable law.
1. Personal Data We Collect
When you use the Site, we collect the following categories of personal data:
- Contact information: your email address, and your name if you choose to provide it.
- Age or birth-year information: a simple age or birth-year field on the sign-up form, collected solely to confirm you meet our minimum age requirement and to make sure we do not use data from anyone under 18 for targeted advertising (see "Online Advertising" below).
- Technical and device data: your IP address, browser type, device type, referring page, and standard web server log data, collected automatically by our hosting provider, Cloudflare, Inc., for security and site-operation purposes.
- Email engagement data: whether you open or click the emails we send you, and your delivery/subscription status, collected through our email service provider, Klaviyo, Inc.
We do not currently collect: payment or billing information (we do not sell anything on the Site yet), body measurements, fitness or performance data, GPS or location data, photos or videos you upload, or any data from wearable devices or fitness apps. If that changes when our online store launches, we will update this policy before we begin collecting it. Sign-up data will not be used for automated decision-making.
2. Children and Teens
Minimum age. The Site is intended for visitors age 13 and older. We do not knowingly collect personal data from anyone under 13. If we learn that we have collected personal data from a child under 13, we will delete it promptly. If you believe we may have collected information from a child under 13, please contact us at privacy@oyoyovolleyball.com.
Teens (13–17). If you are under 18, we encourage you to review this policy and our Terms of Use with a parent or guardian before providing your email address.
Quebec residents. If you are located in Quebec and are under the age of 14, a parent or guardian must provide consent on your behalf before you sign up, as required by Quebec's Act to modernize legislative provisions as regards the protection of personal information (Law 25).
Athlete partners under 18. Any brand ambassador or community-event relationship involving an athlete under the age of majority is contracted through, and requires the consent of, that athlete's parent or legal guardian. These relationships are handled directly, outside of the Site, under separate written agreements.
3. How We Use Your Personal Data
- To send you email updates about oYoYo, including brand news and notice of our store launch, where you have given consent as described below;
- To operate, secure, and troubleshoot the Site;
- To confirm eligibility (age) requirements and apply the advertising restrictions described in Section 5;
- To comply with applicable law and enforce our Terms of Use; and
- For any other purpose we describe to you at the time we collect your information.
4. Marketing Communications and Your Consent
When you sign up on the Site, you are asked to actively check an unticked consent checkbox before we will send you marketing emails — we do not pre-select consent for you. Every marketing email we send will identify oYoYo as the sender, include our mailing address, and provide a working unsubscribe link, in accordance with Canada's Anti-Spam Legislation (CASL) and, for recipients in the United States, the CAN-SPAM Act. You may withdraw your consent and unsubscribe at any time by using the link in any email or by contacting us at hello@oyoyovolleyball.com.
5. Online Advertising
We do not currently run paid advertising. As oYoYo grows, we expect to advertise using email marketing and, potentially, services such as Meta (Facebook/Instagram), and likely TikTok, Pinterest, and Google, which may include tracking pixels placed on the Site and "custom audiences" built from hashed versions of email addresses you provide to us.
WE WILL NOT USE PERSONAL DATA FROM A USER WE KNOW TO BE UNDER 18 YEARS OLD TO SERVE TARGETED OR INTEREST-BASED ADVERTISING.
The age or birth-year field described in Section 1 exists specifically so that we can identify and exclude under-18 users from any targeted-advertising audience before this section becomes operative.
6. Cookies and Similar Technologies
At this stage the Site uses only the technical cookies necessary for Cloudflare to host and secure the page; we are not currently running cookie-based analytics or advertising trackers.
If we begin using cookies, pixels, or similar technologies for analytics or advertising (see Section 5), we will add a cookie or privacy-choices banner to the Site and will honour the Global Privacy Control (GPC) signal and other applicable opt-out mechanisms before doing so.
7. Sharing of Your Personal Data
We share personal data with the following categories of recipients, for the business purposes described:
- Cloudflare, Inc. — website hosting, performance, and security;
- Klaviyo, Inc. — email sign-up capture and delivery of marketing communications;
- VMO Limited Partnership, our affiliate — shared technology and platform infrastructure used to operate the Site on our behalf;
- Advertising partners (Meta, and likely TikTok, Pinterest, and Google) — once implemented, for the advertising purposes described in Section 5, subject to the restriction in that section; and
- Other third parties where necessary to comply with a legal request or court order, protect our rights, or with your consent.
We do not sell your personal data.
8. Cross-Border Data Transfers
Cloudflare and Klaviyo process and store personal data on servers located in the United States and elsewhere. This means your personal data may be accessed by government authorities or courts under United States law. We disclose this in accordance with the requirements of the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and British Columbia's Personal Information Protection Act (PIPA).
9. Data Retention
We retain your email address and related sign-up data for as long as you remain part of our community, or as needed to comply with legal, accounting, or anti-spam recordkeeping obligations. If you unsubscribe or cease to be a member of our community, we retain a minimal record (such as your email address and unsubscribe date) as required to honour your opt-out and to comply with CASL and CAN-SPAM.
10. Your Rights and How to Manage Your Data
Subject to applicable law, you may request to: (i) access the personal data we hold about you; (ii) receive a copy of it; (iii) correct inaccurate data; or (iv) delete your data or unsubscribe from our list. We will not discriminate against you for exercising these rights.
To make a request, contact us at privacy@oyoyovolleyball.com. We may ask you to verify your identity, such as by confirming the email address associated with your request, before we act on it.
11. Security
We use reasonable technical and organizational measures, including those provided by Cloudflare, to protect the personal data we hold. No website or system is completely secure, and we cannot guarantee absolute security.
12. Changes to This Policy
We may update this policy as our practices change — in particular, as we move from a pre-launch sign-up page to a full online store. We will post the updated policy on the Site and revise the "Last updated" date above. If we make a material change to how we handle your personal data, we will provide notice or seek your consent where required by law.
